Locum Senior Education and SEND Lawyer – Competitive Rate – Part-time – Hybrid, flexible Working – South-East England
Locum Senior Education and SEND Lawyer
Local Authority based in South-East England
3 month rolling contract
Part time, flexible hours per week
Hybrid role
Venn Group is working with a fantastic local authority in South-East England in their search for an Senior Education and SEND Lawyer on an Locum basis for an initial 3-month role (with the potential to be extended)
Requirements:
*Qualified Solicitor or Barrister in England and Wales with a valid practising certificate, or equivalent legal qualification.
*Significant experience providing legal advice and representation in adult social care matters, including applications to the Court of Protection and High Court.
*In-depth understanding of the Care Act 2014, Mental Capacity Act 2005, Health and Social Care Act 2008 and related legislation.
*Strong advocacy and analytical skills with experience in managing complex cases, including judicial reviews, welfare and best interest cases.
Duties and Responsibilities:
The successful candidate will be responsible for:
*Provide expert legal advice and representation for the Adult Social Care Department on complex matters, including:
*Court of Protection and High Court applications (e.g., Deputyship, welfare and best interests, deprivations of liberty, s21A challenges, and judicial review).
*Advising on Council responsibilities under relevant legislation, including the Care Act 2014, Mental Capacity Act 2005, Health and Social Care Act 2008, and the Mental Health Act 1983.
*Handling cases on topics such as ordinary residence, safeguarding, provider failure, section 117 aftercare, and deprivation of liberty for 16-17-year-olds.
*Act as a legal advocate for the Council, providing accurate and timely advice in court as required.
*Build and maintain effective partnerships with both internal departments and external agencies.
*Contribute to the improvement of legal service delivery within the Council’s Adult Social Care Legal Team.
